These Terms & Conditions govern the sale of used machinery by ML Machinery E.K.. They define the legal framework for all transactions and set clear expectations for both us and our customers.
These Terms apply to all sales of used machinery (including but not limited to tractors, excavators, etc.) by ML Machinery E.K. to business customers (B2B).
All offers are subject to confirmation and are non-binding until explicitly agreed in writing by ML Machinery E.K..
The contract is considered finalized once the buyer has signed a purchase agreement or pro-forma invoice.
All prices are quoted in euros (€).
Payment is made in two stages: a deposit upon order, with the balance due before the machinery is collected.
Prices are based on Ex-Works (EXW) Schrobenhausen unless otherwise agreed.
ML Machinery E.K. provides a limited warranty for used machinery, which applies only to defects identified during a certified inspection.
Normal wear and tear is excluded from warranty coverage.
Any defects must be reported within 14 days of receiving the machinery.
Ownership of the machinery remains with ML Machinery E.K. until the full and irrevocable payment is received.
Delivery is made Ex-Works (EXW) Schrobenhausen or FCA when the carrier picks up the goods.
The buyer assumes all risk once the goods are loaded onto the carrier or delivered at the premises.
This agreement is governed by the laws of the Federal Republic of Germany.
Any legal disputes related to this contract will be resolved exclusively in the jurisdiction of Schrobenhausen, Germany.-
